A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

Despite the fact that the Defendant is not a narcotics handler, the Defendant handled psychotropic drugs-related Mesofts (one philopon; hereinafter “philopon”), as follows:

1. Purchase and medication of phiphones on January 28, 2015;

A. On January 28, 2015, at around 15:47, the Defendant remitted 60,000 won of philopon to a new bank account in the name of D used by C, and at around 15:54 of the same day C re-transfered the above 60,000 won to a non-bank account used by E, and at around 21:00 of the same day, the Defendant got approximately 0.8g of philopon, which was entered in the front of the F apartment in Ansan-gu, Annyang-gu, Annyang-si.
