A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is the representative of the industrial chain “C” by livestock products in Seogugu-gu.

1. Violation of prohibition of false labelling;

(a) No person who violates the prohibition against false labelling of date of manufacture shall indicate or advertise different contents in indicating the date of manufacture, period of distribution, date of disturbance or date of distribution of livestock products, and other date of manufacture or distribution;

From June 2015 to October 15, 2015, the Defendant manufactured 13,520 gg, 81,120,000 goods from the place of business of the Defendant, from around June 2015, to around October 15, 2015, and sold to the marg distributor in Daegu, indicating the date of manufacture on the following day, not the date of actual manufacture.

As a result, the defendant displayed the manufacturing date of livestock products differently from the facts.

(b) No person who violates the prohibition against false labelling of storage methods shall indicate or advertise the names, manufacturing methods, quality and nutrition labelling of livestock products, nutrition values, raw materials, ingredients, ingredients and uses of livestock products, and other details different from the facts of the relevant products;

From around October 2012 to October 15, 2015, the Defendant manufactured air conditioning goods of KRW 72,680 g, 436,080,000 from C’s place of business, and sold them to the shackers in Daegu by using packages marked as freezing goods, even though they were air conditioning goods.

Accordingly, the defendant displayed or advertised contents different from the facts of the relevant livestock products.

2. Where necessary for public hygiene, the Minister of Food and Drug Safety may determine and publicly announce the standards for the methods of processing, packaging, preserving, and distributing livestock products and specifications of ingredients of livestock products (hereinafter referred to as "standards and specifications of livestock products"), and no livestock product that fails to meet the standards and specifications of livestock products shall be sold, stored, transported, or displayed for sale;

(a) to purchase and use livestock products that are subject to permission (report) to violate the prohibition on the purchase and use of such products by an unauthorized company;
