1. The Plaintiff, Defendant B, D, G, and H respectively, KRW 50,00, Defendant C, I, and J respectively, KRW 100,000, and Defendant B with respect thereto.

1. Facts of recognition;

A. The Plaintiff is an artist who started from February 2007 to run a private broadcasting station called “L” in K from the end of 2009 to the Internet broadcaster and contributed to various TV programs.

B. On July 28, 2006, the Plaintiff was judged at Physical Grade I as a result of a physical examination for conscription, and was enlisted in active duty service on November 20, 2007, but was enlisted in active duty service on the ground that the spirit, treatment and appraisal of the results of the physical examination are necessary.

On December 9, 2014, the director of the Seoul regional military manpower office, after the physical examination of the plaintiff, assigned the plaintiff to be enlisted in active service again on December 9, 2014.

C. On March 25, 2016, the Plaintiff filed an administrative litigation seeking the revocation of the above disposition of military service and rendered a judgment in favor of the Plaintiff to revoke the disposition on the grounds that the above disposition of military service was illegal (Seoul Administrative Court Decision 2015Guhap52692), and the Seoul Regional Military Manpower Office appealed and filed an appeal, but all appeals and appeals were dismissed.

On October 13, 2016, Defendant B posted an article containing the Plaintiff’s photograph as a title / [O] on the N page of the media company M M, and written the article’s comments on the article’s news “I am exempt from feat”.

마. 피고 C은 2016. 9. 19. M라는 언론사의 N 페이지에 [P]이라는 제목으로 원고의 사진이 포함된 기사가 게시되자 위 기사에 “군대안가려면 귀신보는연기 좀더리얼하게하던지 ㅋ ㅋ ㅋ 방송은 존나열심히하더만 ㅋ ㅋ ㅋ ㅋ 그정신으로 군대를가 십색갸”라는 내용의 댓글을 작성하였다.

바. 피고 D은 2016. 9. 21. M라는 언론사의 N 페이지에 [Q]이라는 제목으로 원고에 관한 기사가 게시되자 위 기사에 “이세낀 지가 병신이 되고싶나보네 ㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋㅋ군대안가려고 ”라는 내용의 댓글을 작성하였다.
