Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
From July 2015, the Defendant was dismissed from office on March 2, 2017 due to the resolution of the management body committee and the occupant voting.
1. On April 4, 2017, the Defendant: (a) had D staff E, a management company, enter “Cju Complex Management Committee, the Seo-gu, Incheon, B, and the representative of the management office of the sixth floor”; and (b) stated “F, Seo-gu, Incheon, and the representative G of the management office of the first floor in the debtor column” in the column of creditors of “application for compulsory auction of real estate” in the above C6’s management office; (c) stated the bottom of the above document as “A, a representative of the creditors Cju Complex Management Committee” with the originator’s indication on the bottom of the document; and (d) stamped the Defendant’s seal on the back of the name of the above A; and (d) stated the application for compulsory auction of real estate prepared by the Incheon District
Accordingly, for the purpose of exercising, the Defendant prepared a letter of “application for compulsory auction of real estate”, which is a private document concerning rights and duties, and exercised it, by gathering the representative qualification of the CB Complex Management Body.
2. On the 14th of the same month, the Defendant, at the above C management office, stated in the case number column of “2017th 407th 407 letter of withdrawal of an objection against management service fees” as “H of the D representative director of the Co., Ltd. and “Seoul-do Bupyeong-si 407 management service fees” in the “2017th 407 management service fees” and then withdrawn an objection against “A” in the “2017th 407 management service fees.” On the 14th of the same month, the Defendant, by stating as “A of the C management office,” made the above A’s name and stamped the Defendant’s seal and affixed the Defendant’s seal, and on the same day, sent to the said court employees aware of the fact that the application for compulsory auction prepared by the Incheon District Court
Accordingly, the defendant is qualified as a representative of the C&A management body for the purpose of exercising.
