Defendants shall be punished by imprisonment with prison labor for four months.
However, as to the Defendants for one year from the date of the final judgment of this case, the Defendants are above.
Reasons
Punishment of the crime
Defendants are drivers of cargo vehicles who enter into a contract of carriage with F Co., Ltd. (hereinafter “F”) which is a logistics-related company of E Co., Ltd. (hereinafter “E”), and are members of the E-Subdivision, who are members of the E-Subdivision.
As the Defendants terminated the contract with the Defendants on February 8, 202, the Defendants continued to engage in the strike with F to require F to conclude a direct transport contract with E from February 8, 2020 to Educheon Factory located in G from Dongducheon-si.
In the process of the strike, the Defendants: (a) did not take part in the members’ demand; (b) agreed to use the Jcodo Sports Vehicle driven by Defendant C to threaten the above engineers or to exercise physical power in order to interfere with the livelihood transport of cargo drivers who do not participate in the strike while returning to the farm of Gyeonggi-do.
