A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

On January 12, 2017, the Defendant was sentenced to imprisonment with labor for a violation of the Act on the Control of Narcotics, etc., at the Seoul Central District Court on January 13, 2018, and completed the execution of the sentence at the Gwangju Prison on January 13, 2018.

【Criminal Facts】

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Meblopon (one philopon; hereinafter referred to as “philopon”) as follows:

1. On May 27, 2018, at around 22:44, the Defendant transferred KRW 1.3 million to the E bank account in the name of D, using a cash payment machine located in the Dong-si site in Pyeongtaek-si in Gyeonggi-do, to the E bank account in the name of D. On May 28, 2018, the Defendant received approximately 5 g of opphonephones contained in D in plastic bags in the HG vehicle operated by D on May 28, 2018.

Accordingly, the defendant purchased approximately five grams from D in 1.3 million won.

2. On May 2018, the Defendant: (a) inserted approximately 0.1g of the phiphones purchased from D in a single-use telephone, dilution into a single-use telephone; and (b) injected them into his arms in a SNS; (c) injected approximately 0.1g of the phiphones into another single-use telephone; and (d) injected the phiphones by means of inserting them into the Defendant’s arms in a single-use telephone; and (c) dilution them with water.

Accordingly, the Defendant conspired with G to administer philophones.

3. On August 2018, the Defendant: (a) taken out approximately 0.1g of philophonephones from men in the name undisfortunate that he/she became aware of through SNS in the mutual unfortunateel near Yongsan-gu Seoul, Yongsan-gu, Seoul; (b) injected philophones by means of injecting them into the Defendant’s arms bloodline after dilution; and (c) 0.1g of philophones purchased from D as above, the Defendant laid down approximately 0.1g of philophones to the above men in the name unfortune.
