1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Facts of recognition

In light of the facts without dispute, Gap evidence Nos. 2 and 3, Gap evidence No. 5-1, 2, Gap evidence No. 6-2, and Gap evidence No. 8-5, the following facts are acknowledged.

The Defendant is a school juristic person operating C secondary and high schools, and the Plaintiff was newly employed as a teacher of C secondary and high schools on March 1, 2016, and was subject to the revocation of appointment by the Defendant on August 31, 2017.

In order to pass the first examination to determine successful candidates, successful candidates of the first examination shall be determined in the order of high scores in the aggregate of 20 points in each subject, 30 points in the evaluation of personality and job ability, 50 points in the first examination (education and majors), and 40 percent or more in the major, from among those who score at least 50 percent in the first examination (education and majors).

The number of successful examinees shall be five times the number of persons to be selected by item.

(Provided, That this shall not apply to a small number of employees)

7. The test score of the first test for the decision on successful applicants shall not affect the results of the second and third test.

8.A person who has been determined as a final successful candidate to cancel the final passing shall cancel the passing:

A qualified person or disqualified person;

(b) Cheaters and unfair conducters;

9. Matters concerning the results of examination;

(a) The final examination of the first examination shall use the same kind of black paper (it shall not be crossed off and shall not be able to use a type of paper or private pen), and the answer sheet with unnecessary indications (personal information exposure or cancer) shall not be given in the answer sheet and answer sheet prepared by non-designated pen.

(g) will not be employed if there is no eligible person.

I. A person falling under any of the following is treated as a Cheating.

6) Other unlawful means that affect the fair administration of the Examination (7) examinations conducted by the Defendant or by any other person. The Defendant, on December 9, 2015, shall conduct a competitive examination for appointment of candidates for private and secondary schools (hereinafter “instant examination”).
