Reasons
Punishment of the crime
[Criminal Power] On January 8, 2015, the Defendant was sentenced to three years of imprisonment for fraud at the Daejeon District Court, and was released on February 29, 2016 from Daejeon Correctional Institution and passed on March 29, 2016.
【Criminal Facts】
1. On May 15, 2018, around 08:34, 2018, the Defendant posted a notice stating that he/she would sell an electrical pro and pro and pro and pro and pro and pro and pro and cons to the Internet FF car page, and then falsely said that he/she would deliver the pro and pro and pro and pro and pro and pro and pro and pro and pro and de of the war to the victim who contacted with the report.
However, even if the defendant receives money, he did not have the intention or ability to deliver the same.
Nevertheless, the Defendant, by deceiving the victim as above, received 80,000 won from the victim to the post office account in the name of the Defendant on the same day.
2. On May 15, 2018, the Defendant: (a) posted a notice stating that the Defendant sold a license on the Internet FF car page at the same place; and (b) sent money to the victim who reported and contacted, the Defendant made a false statement that he/she would deliver the license to the victim.
However, even if the defendant receives money, he did not have the intention or ability to deliver the writing.
Nevertheless, the Defendant, by deceiving the victim as above, received 80,000 won from the H bank account in the name of the Defendant on the same day.
3. The Defendant, on May 16, 2018, posted a notice at the above place, stating that he sold an Internet FF car page, and falsely told that he would deliver the habiter if he remitted money to the contacted victim.
However, even if the defendant receives money, he did not have the intention or ability to deliver the habitor.
Nevertheless, the defendant deceivings the victim as above and transfers 150,000 won to the H bank account under the name of the defendant on the same day from the victim.
