Punishment of the crime
Defendant
A serving in the “F” as prescribed in subparagraph 703 of the E building in Nam-gu Incheon Metropolitan City, and the “G” is an organization jointly organized by the disabled-related organization in Incheon Metropolitan City in order to resolve problems related to welfare, education, discrimination, etc. of persons with disabilities while serving in the H position of “G”, Defendant B serving in the “J” on the 6th floor of the I building in Nam-gu Incheon Metropolitan City.
In October 29, 2015, the Defendants held a press conference to express opinions opposing to the reduction of the welfare budget of the Incheon City in front of the Incheon City’s main office of viewing on October 29, 2015, and were willing to withdraw the position of the Incheon City and to force an assembly to accomplish the position of G.
1. A person who intends to hold an outdoor assembly or demonstration shall submit a report on assembly specifying the matters related thereto to the head of the competent police station from 720 hours to 48 hours before commencing the outdoor assembly or demonstration;
At around 11:00 on October 29, 2015, Defendants held a briefing session to express their opposition to the reduction of the welfare budget for the disabled of Incheon city in the same place from the same day to 21:00 on the same day without being dissolved, and without reporting the meeting to the head of the competent police station in Incheon City including G members, Defendant A took part in an assembly by 100 members and activity assistants of the disabled organization, including G members, and Defendant B took part in the assembly as representative, and Defendant B took part in the assembly. Defendant B took part in the assembly by requiring a market interview along with the Defendants to withdraw the position of the reduction of the welfare budget for the city of Incheon.
2. The organizer of an assembly or demonstration in violation of the code of practice shall commit an act that disturbs the order by means of violence, intimidation, damage, fire prevention, etc.
