1. The Defendant’s KRW 3,4170,00 and the Plaintiff’s annual rate from May 16, 2017 to December 20, 2018.

1. Basic facts

A. On October 21, 2015, C entered into a design contract with the Plaintiff on October 21, 2015 with respect to the construction of a new building on the ground (including the underground 1st floor, the total floor area of 2,400 square meters) of 3323 square meters of forest land in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-si, Seoju (around 12520 square meters, divided as follows:

The above contract includes construction design cost (90,000 won per ordinary) and civil engineering design cost (cafeteria 9,000,000), and C provides all the documents (ownership relation, etc.) necessary for building permission at the request of the Plaintiff at the time of the Plaintiff’s request, and agreed to pay for the design work already performed when the design work is discontinued due to termination of the contract.

C. On January 25, 2016, the Plaintiff, the Defendant, C, and D concluded a building design contract under the premise that the said F land was divided into H land. Accordingly, the Plaintiff and the Defendant concluded a design contract from May 24 to September 30, 2016 with respect to the new construction of the third unit of the first building on H (the fourth floor on the ground of the underground second floor, the total floor area of the 974 square meters) in Seocho-gu, Seo-gu, Seoju-gu, Seoul, with respect to the contract amount of KRW 34,705,00 (including the construction design cost of KRW 99,00,000, the civil engineering design cost of KRW 5,500,000) and the service period of May 24, 2016 to September 30, 2016.

After that, around May 20, 2016, neighboring parks, which cannot be constructed among the above F land, were left, and constructed parts were divided into H forest and forest land into 2513 square meters.

On June 30, 2016, pursuant to the instant design contract, the Plaintiff applied for a building permit to newly build one multi-family housing (B) on the land of Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, and applied for a permit to engage in development activities to change the form and quality of the housing site and a permit to convert a mountainous district to a total of 673 square meters among the above land. In addition, the Plaintiff filed an application for a permit to change the form and quality of the housing site and a permit to convert a mountainous district to a total of 673 square meters under the instant design contract.
