Reasons
Punishment of the crime
【The Defendant was sentenced to one year and eight months of imprisonment for a crime of violation of the Punishment of Violences, etc. Act (a collective deadly weapon, etc.) at the Incheon District Court on January 14, 2015, and was sentenced to four months of imprisonment for fraud at the Incheon District Court on August 12, 2015, and completed the execution of the sentence at the Incheon Detention House on December 20, 2016.
【The Defendant, on October 23, 2017, posted a letter on the Defendant’s home located in Gyeyang-gu Incheon Metropolitan City, 08:00, 2017, stating that “The Defendant: (a) printed a victim H’s online portal site “Stket” on the Internet portal site at the Defendant’s home located in Gyeyang-gu, Incheon Metropolitan City; and (b) stated that the Defendant was sent money to the Defendant’s corporate bank account (I) by telephone to the said victim despite holding the ticket or having no intent or ability to sell the ticket; and (c) was paid KRW 70,00 from that time to November 30, 2017 by the victim’s account, including that the Defendant received KRW 29,684,200,000 from the victims on the aggregate of 29,00 won, as indicated in the list of crimes attached hereto, until November 30, 2017.
The Defendant, on October 24, 2017, 2017, “2018 Godan 956,” saying, “The Defendant, despite having no intention or ability to send a ticket even if he/she received the ticket purchase price, sells the ticket to the Internet NAV “S” Kaf,” thereby falsely stating, “If he/she gives money to the victim F who reported and contacted, he/she shall send the ticket” and then, he/she shall receive from the victim to the new bank account (K) in the name of J and shall receive KRW 210,000 from the victim to November 26, 2017, and shall receive KRW 2,370,000 in total at one time in the same manner as the attached list of crimes from around that time.
