A defendant shall be punished by imprisonment for not more than ten months.

400,000 won shall be additionally collected from the defendant.

Punishment of the crime

[Criminal Power] On October 1, 2014, the Defendant was sentenced to 10 months in the Incheon District Court for a violation of the Act on the Control of Narcotics, Etc., and completed the execution of the said sentence in the Chuncheon Prison on June 2, 2015.

【Criminal Facts】

1. On June 2, 2015, the Defendant purchased Metropopon (hereinafter referred to as “Metrophopon”). On June 2, 2015, around C’s car parked on a road near the harbor located in the south-gu Incheon Metropolitan City, 400,000 won for C’s psychotropic drugs, and as a result, C took approximately 0.7g of psychotropic drugs.

Accordingly, even if the Defendant is not a person handling narcotics, the Defendant traded psychotropic drugs.

2. Medication of phiphones.

A. On June 2, 2015, the Defendant committed the crime on June 2, 2015, added approximately 0.14g of the philopon purchased from the mutual spopon telephone located in the Nam-gu Incheon Metropolitan City, as described in paragraph (1), into the Defendant’s arms, and injected it into the Defendant’s arms.

Accordingly, the Defendant administered psychotropic drugs, even though he is not a narcotics handler.

B. On June 3, 2015, the Defendant, on June 3, 2015, added approximately 0.14g of the philophones purchased from the mutual spopon in the 307 Incheon Western-ro, Seo-gu, Seo-gu, Incheon, in a single-use telephone, as described in paragraph (1), and injected them into the Defendant’s arms, and added approximately 0.2g of the philophones purchased as described in paragraph (1), into the single-use copon, and dilution them into the Defendant’s arms.

Accordingly, the Defendant administered psychotropic drugs, even though he is not a narcotics handler.
