A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, who is not a person handling narcotics, did not deal with the psychotropic drugs clocks (one-name philopon, hereinafter referred to as the “philopon”), but traded or administered the clopon as follows.

1. At around 18:00 on December 16, 2015, the Defendant issued KRW 350,00 to D, and 350,000,000, and 0.4g gramopon, in D’s car parked on the front road of the said Nonghyup, around 19:00 on the same day, the Defendant injected approximately 0.1g of gramopon, among roopon purchased at the front of the said Nonghyup, and injected it into the following arms.

Accordingly, the Defendant purchased and administered philophones.

2. On January 2016, the Defendant issued 450,000 won to D and took approximately 0.8g of oponphones, and took around 21:00 on the same day, from the toilets inside the building located near the Incheon Southern-gu Port, Incheon-gu, the Defendant used approximately 0.1g of oponphones purchased at the time of first-hand injection, containing approximately 0.1g of opon, and injected them into the following arms.

Accordingly, the Defendant purchased and administered philophones.

3. On April 15, 2016, the Defendant remitted KRW 600,000 under the name of D (E) from the post office account in the name of D, and around the same day, the Defendant took approximately 1.5g of philopon from the dwelling place of the F building No. 808, 402, in Incheon Gyeyang-gu, and 1.5g of philopon from the dwelling place of the F building No. 808, 402, and took approximately 0.1g of philopon from among philopon purchased at the time of a single-use injection, and melted them with water.

Accordingly, the Defendant purchased and administered philophones.

4. On April 27, 2016, the Defendant remitted KRW 450,00 to the above post office account in D’s name for the purchase price of penphones. On the same day, at the residence of the above D, at the dwelling of the above D, approximately 1g of penphones, and at around 22:30 of the same day, at the “H” park toilet in Incheon Gyeyang-gu, at around 22:30 of the same day, containing approximately 0.1g of the penphones purchased as above, and melted with water.
