2. 공무집행방해 피고인은 전항과 같은 일시 및 장소에서 전항과 같은 이유로 112 신고를 받고 출동한 예산경찰서 F지구대 소속 경사 G과 경장 H으로부터 위 E에 대한 위협행위를 제지당하자 화가 나 "이 씹새끼야! 넌 또 뭐냐 뒈지고 싶지 않으면 꺼져라 좆만한 새끼야!"라고 욕설을 하며 손으로 H의 멱살을 잡고 H의 허리를 잡아 바닥에 넘어뜨리고, 이에 G이 피고인을 제지하자 "넌 또 뭐냐 이 씹쌔끼야!"라고 욕설을 하며 손으로 G의 멱살을 잡고 G의 경찰근무복 오른쪽 견장을 잡아 뜯어 경찰관의 범죄예방에 관한 정당한 직무집행을 각 방해하였다.
