Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant is a person who had worked as a salesperson at a mobile phone sales store called “C” located in Daegu Northern-gu B from November 2016 to August 2017.

The defendant, who had been an existing customer of the above sales store, opened his mobile phone in his name without the consent of D, and thought that he sold it to a used mobile phone dealer.

Around August 17, 2017, the Defendant opened one mobile phone (F) with access to (E) the damaged company’s website using a computer at the above sales store, and entered the name, date of birth, address, etc. of D in the application form, and entered the name of D in the application form for personal information utilization consent, the radio service standard guide, the service application form, and the partial program application form, and sent the written application form, personal information utilization consent, the standard guide for the radio service contract, the service application form, and the partial program application form through the Internet as if they were duly formed to the employee in charge of the victimized company who knew of the said written application. At that time, the Defendant received one cellphone from the said employee in charge of the damaged company’s market price of KRW 1,152,800, which was opened in the name of D, from April 2018 to April 37, 2018.

As a result, the Defendant forged a file, such as an application for subscription in the name of another person, electronic records, which are electronic records of rights and duties, for the purpose of hindering the management of affairs, and deceiving the damaged company by exercising it, and was provided with property and property benefits from the victimized company.
