피고인은 2013. 02. 03. 14:40경 포항시 남구 B 앞 노상에서 약 5~6명의 행인이 왕래하는 가운데 112신고를 접수하고 출동한 C파출소 근무 경장 D이 현장에 도착하여 순찰차량에서 하차하려 하자 순찰자 운전석 문을 주먹으로 툭툭 치면서 “임마 뭐야 이 짭새 새끼야, 어제 출동한 그 짭새 새끼 아이가, 꺼져 이 짭새 새끼야”라고 큰소리로 말하여 공연히 모욕하였다.
