In light of the records, the court below is just in maintaining the judgment of the court of first instance which acquitted the Defendant on the charge of fraud among the facts charged in this case on the grounds as stated in its holding, and contrary to what is alleged in the grounds of appeal, there were no errors by exceeding the bounds of the principle of free evaluation of evidence and exceeding the bounds of logical and empirical rules

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
