A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, on July 5, 201, entered the Republic of Korea as the seafarer employment status (E-10) of Hanlim Shipping C (29 tons) on July 5, 201, but, on July 5, 2012, entered the Republic of Korea without departure from the Republic of Korea even after the expiration of the period of sojourn.

No one shall move or arrange to move from among foreigners who enter the Jeju Special Self-Governing Province (hereinafter referred to as the "Do") into the airport or harbor without a visa to another area within the territory of the Republic of Korea with no permission of the Minister of Justice for the extension of sojourn area.

그럼에도 불구하고 피고인은 2013. 9.경 제주도 내 불상지에서 중국 인터넷 사이트인 큐큐(QQ) 사이트를 통하여 성이 ‘D’이고 이름은 불상인 중국 여성(이하 ‘D씨’라 한다)으로부터 “중국에서 사증 없이 제주도에 입국한 중국인들 중, 대한민국 육지부로 불법 취업을 위하여 이동할 중국인들을 소개하여 주면, 우리가 그 중국인들을 육지부로 이동시켜 주고, 그 대가로 1명당 50만 원을 주겠다.”는 취지의 제의를 받고 이를 수락하였다.

Accordingly, the Defendant, at the construction site in the previous Jeju-do, proposed the movement of non-Visa Chinese Chinese residents to stay in a large city in the land of the Republic of Korea and obtained the consent of E. For the same purpose, the Defendant introduced two non-Visa Chinese Chinese residents who want to move outside the Do from E. On the other hand, four non-Visa Chinese Chinese residents who want to move outside the Do known through the Internet hosting, who want to move outside the Do directly from the inn of Jeju-do in which they are located, and recruited seven non-Visa Chinese nationals (E, F, G, H, I, J, K, K, and hereinafter referred to as “seven persons, such as E.”).

Since then on October 7, 2013, the Defendant sent seven persons, E, etc. to the 4.5 tons of cargo loaded on L(4,915 tons) of non-scheduled cargo ships between Jeju-Bapoon and the land portion.
