A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

"200 Highest 3029"

1. Around December 20, 2019, the Defendant: (a) called “D” restaurant operated by the victim C in the Defendant’s residence located in Gangseo-gu Seoul Metropolitan Government; (b) carried out as if the Defendant would normally pay the delivery food cost; and (c) ordered delivery by a e-mail with a luminous conference.

However, the defendant did not have any intention or ability to pay the price even if he received food and delivery services from the victim because he was not in his possession.

The Defendant, by deceiving the victim as above, was provided with the above food and delivery service equivalent to the market value of 43,000 won in the Defendant’s residence at around that time, and acquired property profits equivalent to the same amount.

From May 2, 2020 to May 2, 2020, the Defendant enticed the victims by the same method five times in total, as shown in the attached Table 1 of Crimes List, and acquired financial benefits equivalent to KRW 173,000 from the victims.

2. On April 13, 2020, the Defendant: (a) discovered the dives that the victim F was parked temporarily for food delivery in the latter part of the Gangseo-gu Seoul Metropolitan Government B apartment E-dong; and (b) stolen with one set of bits in total amounting to KRW 15,000 in the market price of the victim’s possession, which was located in the delivery box of the above dives.

From May 29, 2020 to May 29, 2020, the Defendant stolen property worth KRW 23,400, total market value of the victims by the same method three times in total, as shown in the attached list 2 of crimes committed.

3. Larceny;

A. On June 7, 2020, at around 10:40 on June 7, 2020, the Defendant taken up 10,000 won of the market price consisting of 10,000 won in the back of the victim's back money, and 1,000 won in the market price consisting of 10,000 won in the victim's back payment card.
