1. Basic facts

A. On March 6, 2008, the Defendant concluded the same insurance contract as the content of the insurance contract (hereinafter “instant insurance contract”) with the Defendant and the Defendant’s wife B as the insured on March 6, 2008.

B. On May 3, 2013, the Plaintiff acquired the instant insurance contract from the Green Damage Insurance Co., Ltd. according to the FSC’s decision to transfer contracts.

C. From December 26, 2008 to August 12, 2014, the Defendant was hospitalized for 361 days in total as indicated below, and accordingly, received insurance proceeds of KRW 72,326,732 in total in accordance with the instant insurance contract.
