A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. A thief: (a) around 01:30 on June 18, 2014, the Defendant: (b) committed theft with a 2.10,00 won, resident registration certificate, driver’s license, credit card (national bank, new bank, SCB bank), three copies of the cash owned by the victim and two copies of the C, which were parked in the street near the Southern Pian Elementary School located in 14, Namwon-si, Namwon-si; (c) and (d) the victim’s cash stored in the train.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. On June 18, 2014, around 02:48, the Defendant purchased and calculated goods at the F convenience store located in Namwon-si, Namwon-si, the Defendant acquired the goods of the same amount and used stolen credit cards by presenting the stolen credit card (G) under the name of C as if it were his/her genuine card and paying 6,300 won for the price of goods, as stated in paragraph (1).
B. On June 18, 2014, at around 03:40, the Defendant: (a) boarded a taxi in the street near the Southern-si, Chungcheongnam-si; (b) moved to the vicinity of the front week located in the West-dong, Chungcheongnam-gu, Seoul; (c) paid taxi charges; and (d) paid a new bank (G) in the name of C, as provided in paragraph (1), which was stolen, belongs to one’s own genuine card; and (d) presented it as if it was its genuine card; and (e) paid 78,000 won under the name of the taxi fee, and used the stolen credit card.
C. On June 18, 2014, around 04:11, the Defendant paid accommodation charges at “I” telecom located in Seojin-gu, Seojin-gu, Seoul, the Defendant, as indicated in paragraph (1), paid 35,00 won for a new bank (G) in the name of the stolen C as one of his/her genuine cards, and presented it as one of his/her own real cards, thereby obtaining profits equivalent to that amount, and used the stolen credit card.
On June 18, 2014, the Defendant purchased and calculated goods at the J convenience store located in Seojin-gu Seoul Metropolitan Government H around 04:47.
