피고인들은 2013. 2. 18. 19:30경 대구 달서구 C에 있는 피해자 D(58세)의 주거지에서, 피고인 A는 한손으로 피해자의 멱살을 잡아 흔들고 다른 한손으로 피해자의 뺨을 수회 때리면서 다시 주먹으로 오른쪽 눈 부위를 1회 때리고, 그 옆에서 이를 보고 있던 피고인 B도 합세하여 피해자에게 욕설을 하면서 피해자의 머리채를 손으로 잡아 흔들며 허벅지 등을 발로 수회 찼다.
