A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2018 High Order 1450] The Defendant concluded a check contract with B from July 10, 1993 and traded checks.

On October 2017, the Defendant issued one copy of the family check in the Defendant’s name, which was named as “E”, “E”, “5,000,000 won at face value”, and “the date of issuance” under the Defendant’s name, and presented the check on April 17, 2018, which is within the period for presentation of payment, but did not receive a disposition of suspension of transaction, at the end of the same day, the Defendant issued two copies of the household check with face value of KRW 10,000,000 in the sum of face value, such as “D” office operated by the Defendant, and presented two copies of the check within the period for presentation of payment, but did not receive a disposition of suspension of transaction.

[2] From July 10, 1993, the Defendant entered into a check contract with B and traded household checks. On November 2017, 2017, the Defendant issued three copies of the family check in the name of the Defendant as of May 31, 2018, and presented three copies of the check number “F”, “G”, “H”, “H”, and “H”, respectively, at the office of “D” in the Defendant’s management of the Defendant, which was held in Seocheon-si, Dancheon-si, a police officer on November 2017, and presented three copies of the check in the name of the Defendant as of May 31, 2018, during which the check was presented, but the check was not paid as suspension of transaction.

[2018 Highest 1624] Defendant 1 issued one copy of the household check in the name of the Defendant, which was named as the representative of “D” located in Oracheon-gu, Oracheon-si, and entered into a bank check contract with B from July 10, 1993 and entered into a bank check transaction, around August 10, 2017, the check number I, face value “I”, “5,00,000,000”, and “date of issuance” as of April 30, 2018, for which the holder of the check presented the above check around April 30, 2018, the check did not receive suspension of transaction from that time until November 2017.
