Reasons
Punishment of the crime
B is the representative director of D Co., Ltd. who is engaged in the business of manufacturing and selling sprinkes in E, as the chief of business of D Co., Ltd., who is in charge of entering into a construction contract with farmers under the direction of B, and the defendant is a person who cultivates crops by using the sprinks facilities.
Since 2012, the Ministry for Food, Agriculture, Forestry and Fisheries established a 50% of the total project cost (hereinafter referred to as "self-payment") when farmers install a hacker joints for the hacker facility as one of the energy-using projects. The Ministry implemented a project to support the installation of energy-saving facilities to assist the remaining 50% with national expenses, Do expenses, Si expenses, and Si/Gun expenses.
Defendant, B, and E do not bear all or part of the amount to be borne by the Defendant, who is a subsidized project operator, or agreed to bear part of the amount to be borne by the Defendant on the condition of additional construction, but there was a false financial transaction statement, quotation, etc. as if the Defendant paid all of the amount to be borne by the Defendant.

Around March 2012, the Defendant conspired with B and E to bear only KRW 8,00,000 among the Defendant’s workplace located in Seocheon-gunF, Chungcheongnam-gun, and the Defendant’s share of KRW 7,00,000 among the Defendant’s share of KRW 7,00,000,000, the Defendant submitted a false statement of financial transactions and a written estimate stating as if the Defendant paid the full amount of KRW 53,180,00 among the total share of KRW 105,590,00 (subsidies KRW 52,421,00,000 and KRW 53,180,000).
However, on April 8, 2013, the Defendant deposited the money in advance to the Agricultural Cooperative Account (Account Number: G) under the name of the Defendant, at the Domcheon-dong Branch in B and B, and around April 8, 2013, and again, to bear part of the Defendant’s charges, such as transferring KRW 59,664,00 from the said account to the Agricultural Cooperative Account (Account Number: H) in the name of D.
