Reasons
1. Basic facts
A. 1) The Plaintiffs are the parties to the dispute. The Plaintiffs are the C apartment in Gangnam-gu Seoul Metropolitan Government (hereinafter “C apartment”).
2) The building owner of the apartment site in this case is the reconstruction association established for the housing construction project that removes existing apartment units on the ground of Gangnam-gu Seoul Metropolitan Government D (hereinafter “instant land”) adjacent to the boundary of the north of the instant apartment site and constructs A primary apartment units (hereinafter “the instant construction project”), and the merged Samsung C&T Co., Ltd. (hereinafter “T&T”) is the construction project of the instant construction project.
B. Around 2010, the Defendant Samsung C&T was selected as the trial contractor for the instant construction. Defendant Samsung C&T was the foundation for the instant construction from the immediately following date, and the construction of soil cutting and underground excavation from the instant land (hereinafter “the instant foundation construction”).
