1. Defendant C Co., Ltd. shall pay to the Plaintiff KRW 78,549,698 as well as its annual interest from November 18, 2016 to October 10, 2019.
Reasons
1. Facts of recognition;
A. 1) The Plaintiff is the building of the five-story hospital on the ground of Busan Shipping Daegu D (hereinafter “instant building”).

(2) Defendant B’s redevelopment and rearrangement project association (hereinafter “Defendant B’s partnership”) is a housing redevelopment and rearrangement project association established to implement a housing redevelopment and rearrangement project in Busan, Daegu E-F, adjacent to the northwest of the site of this case, and Defendant C Co., Ltd. (hereinafter “Defendant C Co., Ltd.”) is a contractor who has been awarded a contract from the Defendant’s association for the construction of new apartment units with eight or seven or seven hundred and fifty-three households of the above land (hereinafter “instant construction”).
B. The instant building was used as a convalescent hospital since July 2008 after the process of the instant construction, rupture, damage, and underground water outflow. From March 19, 2015, the construction of the instant building, which was completed around July 2008, there was considerable vibration and shock in the site of the instant construction since around March 19, 2015, and groundwater was leaked, and there was rupture and water leakage on the access roads in the underground parking lots of the instant building. 2) The Plaintiff filed several civil complaints with the head of the Shipping Division from March 19, 2015, and requested the change of the soil rupture of the instant construction, etc. against the Plaintiff’s civil petition, and the Defendant Company partially changed the construction method to the Plaintiff’s civil petition, but the Plaintiff again filed a civil petition with the head of the Maritime Affairs Office around February 20, 2016, to prevent part of the adjacent soil rupture in the instant building site.
