A defendant shall be punished by imprisonment for a term of one year and two months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[Criminal Power] On June 26, 2018, the Defendant received a summary order of KRW 1,50,000 from the Jeonju District Court to a fine for a violation of the Road Traffic Act.
【Criminal Facts】
1. The defendant is in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury).
On October 17, 2019, the Defendant driven the foregoing vehicle while under the influence of alcohol of 0.132% of blood alcohol level on October 17, 2019, and led to the driving of the vehicle in front of the Jinan-gun 24 new intersection road in front of the Jin-gun, Jin-gun, Jin-gun, Jin-do, to the Jin-Eup Myeon.
At the time, there was a signal at night and at the front place, so in such a case, there was a duty of care to reduce the speed to the person engaged in driving service and to prevent the accident in advance by looking at the other vehicles' attitudes in the signal lights and the front door.

Accordingly, the defendant violated Article 44 (1) of the Road Traffic Act not less than twice.
