1. 업무방해 피고인은 2012. 12. 22. 23:00경 서울 구로구 F에 있는 피해자 G이 경영하는 ‘H주점’에서 피해자로부터 영업마감 시간이 되어 술값 61,000원을 계산하라는 요구를 받자 피해자에게 “씨팔 내가 돈 안 준다고 했어 씨팔, 뭐야 술값 줬잖아! 씨팔 놈아, 경찰에 신고해, 경찰 불러”라고 큰소리로 고함을 치며 마시던 유리컵을 바닥에 집어던져 깨뜨리고 다른 테이블에서 술을 마시던 손님에게 다가가 욕설을 하고 시비를 걸어 손님이 가게를 나가게 하는 등 약 30분 동안 소란을 피워 피해자의 호프집 술값계산 및 손님접객 등의 운영업무를 방해하였다.
