피고인은, B, C, A, 성명 불상의 여성 2명과 함께 2014. 7. 26. 21:00 경부터 2014. 7. 27. 08:00 경까지 경기 성남시 분당구 수정구 D에 있는 ‘E’ 이라는 식당 3 층에서 화투 20 장을 이용하여 화투 5 장씩 4 가지 패를 만들어 놓으면 참가자들은 그 중 한 패에 1만 원 내지 500만 원의 돈을 걸고, 화투 5 장 중 3 장의 숫자 합으로 10 또는 20을 만들고 나머지 2 장의 화투 숫자를 더한 끝자리 숫자가 높은 패에 돈을 건 사람이 이기는 방법으로 진행되는 속칭 도리 짓고땡이라는 도박을 하였다.
