A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2016 Highest 292] The Defendant created a place to engage in gambling with C, D, E, F, etc., and conspired to open a gambling place. C, as a “one-person in charge of gambling, such as the preparation of a gambling place, the recruitment of participants in gambling, etc.” D, as a “internal protection,” the Defendant and E, as a “one-person”, intended to play a role to manage the entry, etc. of the participants in gambling in the gambling place, and to sell coffee, coffee, etc. to the participants in gambling within the gambling place, respectively.

Defendant established a gambling place as follows, and each gambling place took charge of the above roles.

2. Defendant, D, and E’s joint crimes, D, and E are the same day from around 00:14 on February 14, 2015.
