A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On June 21, 2013, the Defendant stated to the effect that “The Defendant would send No. 1173, on June 21, 2013, at the Defendant’s home, the Daegu-gu Ulllle, 503, to purchase Samsung No. 503 by accessing a computer to the NAV car page,” and that “the Defendant would send No. 30,000 if the Defendant would send No. 30,000,000,0000,0000,0000,0000,000,000,000,000,000,00,000,00,
As above, the Defendant, by deceiving the victim as above, received 400,000 won from the victim for the purchase price in Nowon-gu on the 22th of the same month from the victim, to the Agricultural Cooperative account under the name of the Defendant.
In addition, the Defendant received KRW 15,578,00 in total as the price for the goods from May 6, 2013 to August 2, 2013 by the same method as indicated in the list of crimes in the same manner.

1. On May 10, 2013, the Defendant: (a) reported the victim’s writing to the effect that the Defendant would have access to the Defendant’s home, 503, Daegu-gu U.S., Daegu-gu U.D., by using a computer to purchase the North Korean street from the bulletin board; and (b) contacted the victim to the effect that “I would send the North Korean street if I would send money to the NA bank account”; (c) However, the fact that the Defendant did not have the North Korean street, even if he received the payment from the said victim, there was no intention or ability to send the North Korean street.
The Defendant received 150,000 won from the victim to the agricultural bank account in the name of the Defendant at around 17:16 on the same day as the purchase price in Nowon-gu.
Accordingly, the defendant was given property by deceiving the victim.
2. On August 2, 2013, the Defendant, at the home of the above Defendant, connects NAV to a computer on August 2, 2013, and opens a cell phone at the bulletin board.
