Reasons
Punishment of the crime
On April 18, 2012, the Defendant was sentenced to six months of imprisonment with prison labor for larceny, etc. from the Suwon District Court in Seoul Northern District Court on July 9, 2014. On November 3, 2014, the Defendant was sentenced to four months of imprisonment with prison labor for larceny, etc. on October 13, 2015. On August 11, 2016, the Defendant completed the execution of the sentence on August 8, 2016, by being sentenced to eight months of imprisonment with prison labor for non-compliance with eviction by the Seoul East District Court.

1. On August 19, 2017, at around 11:40, the Defendant placed the victim D’s “E Burial” located in Jongno-gu Seoul, Jongno-gu, Seoul, in the display stand, the Defendant: (a) placed the victim’s 39,00 won “one automatically 301” (the victim’s market value) and one 27,000 won of the market value; (b) placed one 1 front of the 39,000 won of the 27,000 won of the 27,000 won of the market value; and (c) cut off the above 2nd page and the above 3nd page.
2. On August 21, 2017, at around 12:50, the Defendant put in a bank where one automatic screen is fitted with “10,010,000 won or more” of “LGHBS-510, the market price of the victim’s possession, which was located in the display stand” at the above “E store,” and cut off the said book by inserting it into a bank where one automatic screen is fitted with the market price of KRW 56,00.
3. On August 25, 2017, at around 18:55, the Defendant tried to cut off a phone number of 219,000 “LG HBS-1100” phone numbering to KRW 219,00 at the market price of the victim’s possession, which was located in the display stand at the above “E store,” and Defendant tried to keep Defendant’s witnessing to keep up with the aforementioned witnessing around August 21, 2017, without complying with the following: (a) one “BkBeat at 79,000 won at the market price; and (b) one “BS-510 won at the market price,” which is equivalent to KRW 56,000 at the above “E store”; (c) the Defendant continued to keep up with the victim’s witnessing on August 21, 2017.
