1. The Defendant shall pay to the Plaintiffs each amount of KRW 74,702,50 and each of the above amounts, from October 8, 2013 to October 23, 2015.
Reasons
1. Basic facts
A. 1) The Plaintiffs are the deceased C (hereinafter “the deceased”).
(2) The defendant is a juristic person which has completed the registration of incorporation on March 23, 1948 for the purpose of insurance business, asset management business, etc. which may be run in accordance with the Insurance Business Act and relevant Acts and subordinate statutes.
B. On January 16, 2013, the Plaintiff A entered into an insurance contract with the Defendant for “Family Love Insurance Co., Ltd.” with the Deceased as the insured (hereinafter “instant insurance contract”). The main contents are as follows.
[Insurance Policy] Insured A: Beneficiary of the Insurance Proceeds C: Legal heir: 150,000,000 won [General Injury Death Special Terms and Conditions] Article 1 (Types and Grounds for Payment of Insurance Money) of the Insurance Contract (Types and Grounds for Payment of Insurance Money) shall pay the insurance money agreed to the beneficiary (beneficiary) when any of the following causes occurs to the insured (beneficiary).
1. General injury insurance proceeds: In cases of death as a direct result of an injury during the insurance period of this Special Agreement, the amount of insurance coverage under this Special Agreement shall be paid (Grounds for Non-Payment of Insurance Money) Article 3 (Grounds for Non-Payment of Insurance Money) (1) The company shall not prevent insurance money when any of the following events occurs:
1. The intention of the insured person: Provided, That where the insured person has impaired himself/herself in a state that he/she is unable to make a free decision due to mental disorder, etc., he/she shall pay the insurance money to him/her;
C. (1) The Deceased’s hospitalized treatment and death 1) was conducted on May 2013, 201, when he/she had the Plaintiffs returned, and the symptoms were serious, from August 5, 2013 to August 18, 2013. (2) After which the Deceased was hospitalized under the diagnosis of complication in a D hospital, the deceased was at the domicile of the deceased around 09:50 on September 20, 2013.
