Reasons
Punishment of the crime
On August 28, 2009, Defendant A was sentenced to imprisonment of one year and six months for fraud at the Seoul Central District Court on August 28, 2009, and the judgment became final and conclusive on October 12, 2009.
Criminal facts
The Defendants conspired to have a person who intentionally caused a traffic accident or who is not at the scene of a traffic accident installed as a victim by referring to referring to referring to a person who is not at the scene of a traffic accident, and receive insurance proceeds under the name of agreement, etc. by reporting
1. On March 11, 2008, Defendant A, Defendant C, Defendant D, and Defendant D conspired to intentionally induce a traffic accident with I, J, and K to acquire insurance proceeds. On March 11, 2008, Defendant C intentionally obtained a traffic accident and caused a traffic accident by intentionally obtaining the back portion of the MF passenger vehicle driven by Defendant C, Defendant D, Defendant E, and K on the front side of the Guro Digital Complex on March 23, 2008.
Since then, although the Defendants did not have a different nature from the above traffic accident, they were hospitalized in the NO medical center and the O hospital as they were most likely to be in need of hospitalization, respectively. The Defendants filed a claim for the payment of insurance proceeds with the victim Samsung Fire Insurance Co., Ltd. from March 12, 2008 to March 20, 2008, and acquired the total sum of KRW 9,396,010 from the victim to March 20, 2008 as shown in the annexed crime list 1.
2. On October 26, 201, Defendant A and Defendant F conspiredd with Defendant A and Defendant F, intentionally causing a traffic accident, thereby receiving insurance proceeds. On October 26, 201, around 200:47, at the front of the additional digital group of Geumcheon-gu Seoul, Geumcheon-gu, Seoul, Seoul, as a PDapart car driven by Defendant A, I intentionally obtained the back portion of the PDap car driven by Defendant A and caused a traffic accident.
Afterwards, the Defendants are different from the above traffic accidents.
