A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. The crime on December 1, 2014;
A. On December 1, 2014, between 03:00 and 04:00, the Defendant: (a) intruded into an E office operated by the victim D with a building 204; and (b) cut off one copy of the passbook (Account Number F) and one copy of the seal on the victim’s book; and (c) cut off.
B. At around 09:15 on the same day, the Defendant, without authority, entered “F”, “former KRW 00,000,000”, and “D” in the name column in the application form for a deposit with the intent to exercise at an informational point inside the 345 Enterprise Bank inland branch at Ansan-si, Anyang-si, the Defendant forged one copy of the application form for a deposit, which is a private document with regard to the rights and obligations that was stolen, and demanded a bank employee who is unaware of the forged fact to withdraw the deposit, and upon demanding the bank employee’s name to withdraw the forged fact, presented the forged application form as if it was duly formed with the deposit passbook and exercised the right to submit the forged application form as mentioned above with the deposit passbook. The Defendant was issued from the victim’s bank employee as a legitimate deposit withdrawal.
2. Crimes on January 12, 2015;
A. On January 12, 2015, at around 01:40 to 03:00, the Defendant intruded into an I (State) office operated by the victim H through a window that was not opened up to the second floor from the parking lot pipe of the building in Gwanak-gu, Seoul Special Metropolitan City, and stolen the above company’s national bank corporation head account (Account Number J) and one corporate head by leaving off one point on the victim’s book.
B. At around 09:36 on the same day, the Defendant, without authority, entered “J”, “L”, and “I” in the name column in the application form for a deposit with the intent to exercise at a malicious point of a national bank located on the 465-21th, Gwanak-gu, Seoul Special Metropolitan City Central Office, and forged one copy of the application form for a deposit, which is a private document with respect to rights and obligations, by affixing the stolen corporate seal stamp.
