1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. On October 24, 2007, the Defendant concluded an insurance contract with the Plaintiff with the same content as the attached Form (hereinafter “instant insurance contract”).
B. On November 25, 2008, the Defendant claimed insurance proceeds from the Plaintiff on the ground that the Plaintiff suffered a traffic accident on October 5, 2008, and received from the Plaintiff the total amount of KRW 24,680,50,500 based on the insurance contract of this case from November 25, 2008 to October 28, 2015, after being hospitalized at each hospital as shown in the following [Attachment 1].
