1. The insurance contract concluded between the plaintiff and the defendant is invalid.
2. The defendant shall be the plaintiff.
Reasons
1. Basic facts
A. The Plaintiff and the Defendant concluded an insurance contract on June 4, 2009 (hereinafter “instant insurance contract”).
B. From March 28, 2010 to April 13, 2010, the Defendant paid the Plaintiff’s insurance proceeds and the occurrence of the instant accident, on the ground that the Plaintiff was hospitalized in the instant insurance contract for 431 days (hereinafter “instant insurance accident”), including the Plaintiff’s receipt of KRW 280,00 from the Plaintiff according to the instant insurance contract, on the ground that the Plaintiff was hospitalized in the Republic of Korea at the center of Gangnam Central Hospital for the second left-hand balance of 2.8,00 won. The Plaintiff paid the Defendant the insurance proceeds totaling KRW 17,243,402 as indicated below.
