Defendant shall be punished by a fine of KRW 8,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant is a police officer who was appointed on July 13, 1991 and serves at the Incheon Southern Police Station C commanderat.

1. The portion of publication of false information shall not publish any false information about a candidate (including a person who wishes to be a candidate) with respect to a candidate, his spouse, lineal ascendant or descendant, or sibling unfavorable to him by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or any other means, with the intention of preventing him from being elected, and D was a candidate for the 19th presidential election, and there was no fact that the person who wishes to be a candidate for the 19th presidential election has a sexual relationship with E, F, G visa, the fact that he was involved in G visa, the fact that he sent correspondence to North Korea H, and that his father served for the North Korean people.

A. On January 25, 2017, the Defendant posted a composite photograph of E, D, and F3 in the name of the Defendant using the Defendant’s mobile phone for the purpose of preventing the Defendant from winning D from being elected at the Defendant’s residence, 1501, 102 Dong-gu Incheon, Incheon, or the Incheon East Police Station C police station, using the Defendant’s mobile phone, using the Defendant’s cell phone, in a way of sharing a composite photograph of E, D, and F3 having a sexual relationship in succession.

나. 피고인은 2017. 1. 29. 경 인천 남동구 I, 1501동 102호에 있는 피고인의 주거지 또는 인천 남동경찰서 C 파출소에서 D을 당선되지 못하게 할 목적으로 피고인의 휴대전화를 이용하여 피고인 명의의 페이스 북 계정 (J )에 ‘K ’에 게시된 G 비리에 대한 검찰 수사 관련 기사를 인용하면서 “L” 라는 제목 하에 “D 이 적극 개입하여 행정기관 로비한 G 3 조 사업, 바다이야기에 이어 최대 친북 간첩정권비리가 또 터졌다!!!!!!!!!!!” 라는 글을 기재한 게시물을 공유하는 방법으로 게시하였다.
