Punishment of the crime

No person who publishes false information in violation of the Public Official Election Act shall publish false information about a candidate (including a person who intends to be a candidate) with respect to a candidate, his/her spouse, lineal ascendant or descendant, or sibling unfavorable to the candidate (including a person who intends to be a candidate) by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document

Nevertheless, the Defendant, on June 13, 2018, posted “D, from June 13, 2018, going to a candidate for a Cparty candidate for the Gun election of the Gun of the Dong-si branch nationwide election, the Defendant cannot be elected.” Notwithstanding that D did not own a church under the name of the tea at the Suwon-do, the Defendant’s residence and trade name in Yeongdeungpo-gu, Seoul, on March 12, 2018, published a false fact about D over 11 times in total, as shown in the attached Table 1 of the crime committed from around June 4, 2018 to June 4, 2018, on the Defendant’s account, a social network service website using the Defendant’s Nowon-gu computer and mobile phones, using the Defendant’s Nowon-gu computer and mobile phone.”

No one shall slander a candidate (including a person who intends to become a candidate) or his/her spouse, lineal ascendant or descendant, or sibling by openly pointing out facts through a speech, broadcast, newspaper, communications, magazine, poster, propaganda document, or any other means, with the intention of having another person elected or not having another person elected or having another person elected.

Nevertheless, on June 13, 2018, with a view to preventing D from being elected as a candidate for a Cpolitical party in the election of B head of the Dong-si local election of the Republic of Korea on June 13, 2018, the Defendant’s dwelling and trade name in the defendant’s dwelling and trade name in Yeongdeungpo-gu Seoul Metropolitan Government around March 16, 2018, using the defendant’s Nowon-gu computer and mobile phone.
