A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On October 8, 2013, the Defendant was notified of a summary order of a fine of 1.5 million won by committing a violation of the Road Traffic Act at the Busan District Court, and was notified of a summary order of a fine of 1.5 million won by the same court on December 31, 2013.
1. On February 9, 2014, at around 01:25, the Defendant was under the influence of alcohol by 0.131% of blood alcohol concentration without obtaining a driver’s license, the Defendant driven a vehicle with a volume of approximately 500 meters from the front side of the restaurant in the bean Sea State of Busan, as Busan, to the front side of the Republic of Korea in the center of the Busan East-gu, with a volume of approximately 500 meters.
2. On February 9, 2014, around 01:25, the Defendant: (a) signed the name, resident registration number, and the name and resident registration number of the Defendant’s workplace partner C, who was under normal influence due to his/her influence of drinking driving twice, to be subject to criminal punishment; and (b) signed the name, resident registration number, and the name of the police PDA PDA cell screen that contain the name, resident registration number, and the fact of drinking driving; and (c) forged and used C’s signature by presenting it to the control police officer who is unaware of such fact.
3. On the following, “C” was signed after stating that “I have confirmed that the above entry was the same, and if you recognize as a result of measurement, I have been given notice that I would have to collect blood,” and signed at the same time, place, and without authority, the Defendant’s use of the private document forgery and the use of the private document, at the same time, place, and without authority, for the purpose of uttering, one copy of the report on the state-owned driver’s statement in the name of C, which is a private document concerning the certification of facts, was forged, and the report on the state-owned driver’s statement, which was forged to the control police officer without authority, was duly formed.
