1. Defendant A shall be punished by imprisonment for two years.

However, the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 가. 공무집행방해 피고인은 2015. 9. 1. 12:55경 위 제1항 기재 장소에서 욕설하며 행패를 부리는 것을 평택경찰서 H지구대 소속 경찰관 J로 제지를 받자 화가 나, “내가 뭘 잘못했냐, 이 씹새끼들아, 니들이 경찰이면 다냐, 이 개새끼들아 꺼져”라고 욕설을 하면서 주먹으로 위 경찰관의 가슴부위를 2회 폭행하였다.
