1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. On October 12, 2012, the Plaintiff received a written complaint from the B police station on the grounds that the Defendant C, a defendant, committed a crime of boundary and insult.

B. However, on December 26, 2012, the Plaintiff was served with the Busan District Prosecutor’s Office a written decision of non-prosecution stating that only the offense of insult was suspected (defluence of evidence) regarding the above accusation case.

C. Accordingly, on April 23, 2013, on the ground that the Plaintiff intentionally neglected to investigate the offense of border invasion against the Defendant, who was an investigator in charge of the instant accusation case, the Plaintiff submitted a petition to the Defendant to take appropriate disciplinary action against the said six persons on the ground that he/she did not properly disclose the misconduct of the said persons with respect to G, Inspector H, and Assistant I belonging to the public hearing and auditor office, on the ground that he/she neglected to examine the record of forwarding with respect to the mitigated E and revision F, and obtained approval without examining the omission of the above subordinate.

On July 15, 2013, the Defendant notified the Plaintiff of the result of the civil petition treatment that the Plaintiff took measures such as “a warning”, “the caution” for mitigated E, and “unwritten” for the remaining four persons.

E. On October 7, 2013, pursuant to the Official Information Disclosure Act (hereinafter “Information Disclosure Act”), the Plaintiff filed an application with the Defendant for the disclosure of information on the Plaintiff’s statement, the written statement, or the written statement or the written statement with respect to six petitioners related to the said petition. On October 11, 2013, the Defendant rendered a partial disclosure decision to the effect that “a disclosure decision is made with respect to the Plaintiff’s written statement, and a non-disclosure decision is made with respect to the remaining six petitioners’ written statement or written statement,” and the above written notification was served on the Plaintiff on the same day.

F. The Plaintiff, who is dissatisfied with the above partial disclosure decision, filed an objection on November 7, 2013. After deliberation by the Information Disclosure Council, the Defendant filed an objection on November 18, 2013.
