A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant, while operating a mobile phone sales agent of the Gangseo-gu Seoul Metropolitan Government building A, Dong A 110, was aware of the fact that the circumstances of funds were known to the termination party, subscribed to the mobile phone by stealing the name of the Defendant without obtaining the consent of D and E, whose name was entered, and sold the mobile phone to the medium and medium cell phone seller, and used it for personal use.
2. Facts of crimes;
A. On July 18, 2015, at the same place as indicated in the preceding paragraph, the Defendant entered “D”, “G”, “H402,” etc. in the subscriber column, “G” in the customer address column, using a tample, in order to open the cell phone whose number is “F,” at the same place as indicated in the preceding paragraph, and entered “D” in the applicant column with the signature of “D” in the name of the applicant column. Then, the Defendant drafted a written consent to use the personal information in the name of D, written application to subscribe to the LTE Ppls/S Agreement iPh of LG Plus flus flus iPh of customers in the same manner.
Accordingly, for the purpose of exercising the right, the Defendant forged the application form for subscription under the name of D, personal information utilization consent, LTE Plus/ 30 E-BB discount program, one copy of LG Phone Customer Agreement, and four copies of the written consent of customers using LG Phone, respectively.
2) On July 19, 2015, the Defendant entered “D”, “G”, and “H and 402” in the column of customer address column in the subscriber column using a tample to the application form in order to open an I mobile phone under the name of D, at the above location, and entered “D” in the applicant column, and written a written application for membership in the name of D by signing D on the name next thereto, and in the same manner, written consent for the use of personal information in the name of D;
