Reasons
Punishment of the crime
The defendant was a preliminary candidate for the 6th national local election D party Kimpo-si.
In order to benefit a candidate (including a person who intends to become a candidate) by means of a speech, broadcasting, newspaper, communication, magazine, poster, propaganda document, or any other means, any false information about the place of birth, status, occupation, career, property, personality, act, activity, organization to which he/she belongs, etc. of a candidate, his/her spouse, lineal ascendant or descendant, or sibling, shall not be published in favor of the candidate (including a person who intends to be a candidate). In particular, where he/she publishes an academic background, it shall not be published except the academic background which has completed the regular academic background and foreign educational course equivalent thereto, and where he/she publishes a regular academic background,

Around April 8, 2014, the Defendant: (a) produced 10,00 copies of a preliminary candidate for his/her Kimpo-si, which indicated “F” in the public relations planning company called “F” located in Kimpo-si, Kimpo-si, Kimpo-si; and (b) distributed approximately 1,000 copies of a name tag indicating the non-regular academic background with respect to himself/herself in the long-term Dong, Kimpo-si, etc. around April 9, 2014 to many unspecified electors.
Accordingly, the defendant announced false facts in favor of himself for the purpose of election.
2. On April 10, 2014, at around 16:58, the Defendant posted a false academic background letter on the Internet car page “H” page of the Internet portal server “H” at a place where the Defendant entered the false academic background, and indicated “4. Work experience” column as “(former),” rather than a regular academic background, the Defendant stated “(former) G advisor(9) of the Kimpo University.”
Accordingly, the defendant announced false facts in favor of himself for the purpose of election.
