1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On May 18, 2018, the Plaintiff transferred to D Middle Schools E (hereinafter referred to as “instant school”) from the third and fourth grade.
B. On July 10, 2018, the Defendant was reported by the Plaintiff to assault another student, and was prepared and submitted by F, G, H, I, J, and K each written confirmation of school violence on the same day.
C. On July 11, 2018, the Defendant was prepared and submitted by the Plaintiff a written confirmation of school violence with the purport of “H at the classroom on July 5, 2018.”
On July 12, 2018, the Autonomous Committee on Countermeasures against School Violence in the instant case (hereinafter “instant Committee”) deliberated on the case of school violence with respect to the Plaintiff, and requested the Defendant to take five (5) days of suspension of attendance, transfer, and special education to the Plaintiff, based on the following facts as the cause of the measure (hereinafter “instant cause of measure”).
1. On June 3, 2018, in front of the classroom 6th half of the victim student F (3th grade 6th grade) on June 2018, the Plaintiff, who was in F, opened the classroom in front of the classroom 6th grade, was f, and the Plaintiff responded to the defect F, “Ismi and Besmi,” “Ismi”.
