A shall be punished by imprisonment without prison labor for six months, and by imprisonment without prison labor for ten months, respectively.

However, for two years from the date this judgment becomes final and conclusive.

A served as the chief of the building department of D, who was in force from June 2012 to Scheon Broadcasting, and who was constructed in D, as a general manager at the construction site of the “F Facility Modernization Project” in the construction site of the “F Facility Modernization Project” in the Corporation, and Defendant B took charge of the work management at the construction site, safety management, and work direction supervision for work workers, and Defendant B took charge of dismantling various buildings already constructed at the construction site at the above construction site according to Defendant A’s instructions.

1. 피고인 B 피고인은 2012. 6. 21.경 위 ‘F시설 현대화사업’ 공사현장에서, 피고인 A의 지시에 따라 위 공사현장 내에 설치되어 있던 기존 철근 콘크리트조 2층 공중화장실(높이 약 8미터) 철거작업을 진행하게 되었는바, 당시 위 2층 공중화장실의 경우 벽면 내부에 여러 개의 ‘스테인리스 파이프’와 ‘PVC 파이프’ 등이 설치되어 있었으므로 위 건물 철거작업을 진행하려는 피고인으로서는 사전에 그 건축물의 구조 등을 확인한 후 그에 필요한 작업방법을 선택하여 안전하게 철거작업을 하여야 할 업무상 주의의무가 있음에도 불구하고, 이러한 업무상 주의의무를 게을리 한 채 별다른 확인 및 안전조치 없이 위 굴삭기를 작동하면서 굴삭기에 부착되어 있는 속칭 ‘크라샤’로 벽면 일부를 잡아당겼고 그로 인하여 벽면 내부에 설치되어 있던 위 각종 파이프 등의 반발력에 의하여 벽면 일부(가로 약 110센티미터, 세로 약 400센티미터, 두께 약 12센티미터)가 공사현장 외부에 설치되어 있던 안전휀스 밖으로 튕겨 나가도록 하여 그 공사현장 인근 도로를 보행하고 있던 피해자 H(46세)의 다리 부위를 충격하도록 하여 피해자에게 우측무릎 절단, 좌측 측골 신경손상, 요도손상 등의 상해를 입게 하였다.
