1. 성폭력범죄의처벌등에관한특례법위반(특수강제추행) 피고인은 2014. 4. 7. 06:00경부터 14:30경까지 사이에 서울 서초구 C에 있는 피고인의 여자친구인 피해자 D(여, 23세)의 집에 들어가 피해자의 핸드폰에서 피고인과 헤어지려고 한다는 내용의 카카오톡 메시지를 보고서 격분하여 자고 있던 피해자의 몸 위에 올라가 위험한 물건인 과도(칼날길이 10cm , 총 길이 20cm )를 피해자의 목 부위에 들이대고, 피해자의 몸을 긁거나 찌르는 시늉을 하며 피해자에게 “죽일까 말까 나는 사람을 죽이는 방법을 잘 알고 있다. 칼로 찌를 때 다른 사람들은 잘 몰라서 제대로 잘 못 찌르지만 난 제대로 죽이는 방법을 알고 있다. 어차피 내가 널 칼로 찌르면 아픈 것 느낄 틈도 없이 죽을 테니 걱정 말고 있으라.”고 협박하여 피해자의 반항을 억압한 다음 피해자의 입 안에 자신의 성기를 넣고, 피해자로 하여금 빨도록 하였다.
