A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant was admitted to active duty service on December 4, 2016 and served at the 12th Armed Forces B B, who was enlisted for active duty service.

On September 4, 2018, the discharge from active service was due on the hospital.

1. Indecent acts by force of soldiers;

A. On May 8, 2018, the Defendant: (a) committed indecent act by compulsion against the victim C (Nam, 20 years of age) on May 1, 2018; (b) the Defendant refused to allow the victim to smoke in the same tobacco at the 8 living room of the 2018 Gool-gun D, Gangwon-do; and (c) committed an indecent act against the victim who was a soldier by kising kis on the victim’s name and view respectively; (d) around May 8, 2018 to around 22:0 between the Defendant and around May 8, 2018, the Defendant committed an indecent act against the victim by leaving the victim’s body by skiding the victim’s body with “Isn't get off”; and (d) the victim refused to do so by having the victim skid by kn's body on one hand; and (e) having skid the victim’s body on the victim’s bridge.

3) 피고인은 2018. 5.~8.경 사이 23:00경 위 8생활관에서 침대에 누워있는 피해자의 옆에 누워 팔로 피해자를 껴안고 뽀뽀를 하여 피해자가 싫어하는 기색을 보이자 손가락으로 피해자의 팔뚝안쪽 부위를 꼬집고 비틀어 폭행으로 군인인 피해자를 추행하였다. 나. 피해자 E(남, 20세 에 대한 강제추행 피고인은 2018. 6.~7. 초순 사이 22:30경 위 B포대 9생활관에서 침대에 누워 취침 준비중인 후임병인 피해자의 옆에 누워 “뚱뚱하네, 연애 못하게 생겼네.”라고 말하여 피해자가 기분 나빠 하자, “미안하다.”라고 말하며 피해자의 볼에 뽀뽀를 하고, 다시 “뚱뚱하네, 연애 못하게 생겼네.”라고 말하여 피해자를 놀리다가 다시 “미안하다.”라고 말하며 피해자의 볼에 뽀뽀를 하여 폭행으로 군인인 피해자를 추행하였다.
