1. The Plaintiff in the “E Corporation” tender publicly announced by the Defendant as the finance officer C at B, and opened the D.

1. Basic facts

A. The Defendant publicly announced an electronic bid (hereinafter “instant bid”) with regard to the “E Corporation” (hereinafter “the instant construction”) to the finance officer C at the BB week.

B. The part relating to the instant case in the tender notice is as follows.

1. Matters referred to the tender;

(a) Construction name: E works;

(b) Location: F from one week to one day; and

(c) Business: Total improvement of rivers; 7.4km;

(d) Estimated amount: 22,712,00,000 won (the basic amount of KRW 10,470,973,000 for government-funded materials of KRW 12,241,027,00);

(e) Basic amount: 10,470,973,00 won (estimated price of KRW 9,519,06,364, value added tax of KRW 951,906,636);

(f) Period: 1,460 days (general) from the commencement date of construction (365 days (one minute);

2. Bidding and contracting methods;

(a) the status of the electronic bid using the National Integrated Electronic Procurement System;

(b)the construction subject to the regional restrictions (Seouldo), qualification examinations, total tendering, and integrity contract system;

(c) can independently or jointly enter into a contract (joint performance);

A long-term continuing construction project is promoted, and the contract amount shall be the next contract within the scope of the annual budget.

- The primary cost of work (contract) 650,220,000 won.

4. Qualifications for participation.

(a) An enterprise meeting the requirements under Article 13 of the Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party and Article 14 of the Enforcement Rule of the same Act and shall not fall under Article 92 of the Enforcement Decree of the same Act

나. 「건설산업기본법령」에 의한 종합공사를 시공하는 업종 중 토목공사업(또는 토목건축공사업)을 등록한 자로서 주된 영업소의 소재지를 전라남도 내에 둔 업체이어야 합니다.

(c) The standards for companies in Jeonnam-do shall be located within Jeonnam-do, where the principal place of business (in cases of a corporation, the date on which documents on examination of qualifications are submitted, and the date on which a successful bidder enters into a contract) is located from the date immediately before the date of public announcement of qualifications.
