Punishment of the crime
Defendant
A on July 31, 2007, sentenced to a fine of 10 million won for a violation of the Act on the Promotion of Game Industry in the Busan District Court's Branch Branch Support, and on July 6, 2012, the same court was sentenced to a suspended sentence of 2 years for a year of imprisonment with prison labor due to an attempted offender.
1. Defendant A
A. From May 31, 2016 to June 21, 2016, from around 21:20 to June 21:20, 2016, the Defendant: (a) registered the competent authority as a juvenile game providing business entity; and (b) installed 90 game machine for the entire use of the game; and (c) exchanged the remainder after deducting 10% of the points acquired by the customers from the game.
As a result, the defendant provided game products not classified for use, and carried out speculative business by exchanging tangible and intangible results obtained thereby.
B. From around 10:00 on July 26, 2016 to 15:40 on the same day, the Defendant: (a) registered the competent authority as a juvenile game providing business entity; and (b) installed 99 game devices for the entire use of the game, which had not been rated after setting up the 99 game devices for the game, the Defendant exchanged the remainder after deducting 10% from the points acquired through the game to the unspecified number of customers.
As a result, the defendant provided game products not classified for use, and carried out speculative business by exchanging tangible and intangible results obtained thereby.
2. Defendant B, at the same time and place as set forth in Article 1-2(2), and the owner of a business, despite being well aware that he/she performed speculative acts using game products that he/she did not receive any grade as above, is an employee after receiving 80,000 won per day, and as an employee, he/she conducts coffee and music, etc. of customers.
